All orders accepted by Medicotech are subject to these conditions of sale. Customers ordering from Medicotech agree and accept the terms and conditions and are bound by them for themselves and for any third party they may be ordering for.
Failure to comply with these Terms and Conditions, or any revised Terms and Conditions as We may from time to time impose, may result in refusal by Us to supply Products.
1. DEFINITIONS
In these terms and conditions, the following words shall have the following meanings
- Us, Our & We: Means Medicotech Ltd, Unit 203, Milton Keynes Business Centre, Foxhunter Drive, Linford Wood, Milton Keynes, MK14 6GD.
- Customer & You: Any party/parties who order or purchase any product.
- Days: Means working days, being Monday to Friday inclusive, excluding English bank and public holidays, unless otherwise stated.
- Order: Refers to the placing of an order for Products through any of the means offered by Us to You.
- Products: Refers to any goods and/or services supplied by Us to You.
2. PRICE AND PAYMENT
2.1 All quotations are made and Orders are accepted on the basis that the Product will be charged for at the prices ruling at the time of supply. These prices will be subject to VAT where applicable, at the rate prevailing at that time.
2.2 The Customer shall make payment in full prior to delivery of the Products. Payment shall not be considered effected until the Company receives the funds. The Product remains the property of Medicotech until payment is received in full.
2.3 Medicotech reserves the right to alter the prices of Products without prior notice.
2.4 30-Day Cash Back Guarantee – Medicotech offers a 30-day cash back guarantee. If you are not completely satisfied with your Product you may return it within 30 days to receive a full refund of the Product cost. Please note that the cost of delivery is not included. This offer only applies to new customers using our Products for the first time. A second purchase of the same product, which has been tried for 30 days, will not come with a Cash Back Guarantee.
The Product must be returned in its original packaging, undamaged and complete with all original parts and literature within the 30 day period.
Please contact Medicotech by telephone to notify your intent to return any Product. A covering letter will need to be sent with the product.
You will be required to pay for the postage and it is your responsibility to ensure the Product arrives to us safely and on time. Medicotech will not be held responsible for non-receipt of returned items. In such circumstances no refund will be paid.
3. DELIVERY
3.1 Any time quoted for delivery is estimated only, although We will use all reasonable efforts to deliver Products in accordance with the times specified. Failure to comply with such times shall not constitute a breach of these Terms and Conditions.
3.2 All received Products must be checked on delivery and any claims for missing or damaged goods will not be accepted unless Medicotech is advised within 48 hours of receipt of goods. Medicotech will not consider any claims made outside of the stated notification period.
4. WARRANTY
4.1 Medicotech Products come with a 2-year manufacturer warranty from the date of purchase, provided that the Products are used as stipulated in the instruction manual.
4.2 Safe operation and optimum functioning cannot be guaranteed if third party components are used. Damage incurred by the use of third party components constitutes a breach of warranty.
4.3 Expendable parts, such as batteries, are excluded from the warranty.
4.4 This warranty applies to original purchasers only who acquire their Products new from Medicotech.
4.5 Any Product subject of a valid warranty claim will be replaced at Medicotech’s expense.
5. LIMITED PRODUCT LIABILITY - PRONTOGUARD
While in the opinion of the manufacturers the Prontoguard medical device is generally effective in relieving pain, health care is not an exact science and individual results will vary, accordingly, Medicotech make no warranties to the effectiveness of this Product.
Medicotech will not be liable for any loss or damage, including costs, however caused, whether direct or consequential, incurred or suffered by the purchaser or any third party in respect of the products but nothing contained herein will or will be considered to exclude or restrict any liability on Medicotech’s part for death or personal injury resulting from negligence.
To the maximum extent permitted by law, Medicotech will be under no liability whatsoever whether in contract, tort, (including negligence), breach of statutory duty, restitution or otherwise for any injury, death, damage or direct, indirect or consequential loss (including, but not limited to, pure economic loss, loss of profits, loss of business, depletion of goodwill and like loss).
6. FORCE MAJEURE
We reserve the right to cancel an order or suspend or delay delivery of it without being liable for any loss or damage if supply of the Products is prevented or delayed by reason of war, civil strife, riots, adverse weather conditions, fire, flood, labour disputes, accidents or any other cause or circumstances beyond Our control.
7. EXCLUSIONS
7.1 Medicotech shall not be liable to service, repair or replace parts on any Product other than to its original delivery address.
7.2 No warranty includes any liability for accidental damage however caused.
7.3 These terms and conditions do not affect your statutory rights.
8. LAW
The interpretation and application of these Terms and Conditions shall be in accordance with English Law and You hereby agree to submit to the exclusive jurisdiction of the English Courts.
